176 public digital performance (e.g. webcast) of the Work if
177 that performance is primarily intended for or directed
178 toward commercial advantage or private monetary compensation.
179 2. *Mechanical Rights and Statutory Royalties*. Licensor
180 reserves the exclusive right to collect, whether
181 individually or via a music rights agency or designated
182 agent (e.g. Harry Fox Agency), royalties for any phonorecord
183 You create from the Work ("cover version") and distribute,
184 subject to the compulsory license created by 17 USC Section
185 115 of the US Copyright Act (or the equivalent in other
186 jurisdictions), if Your distribution of such cover version
187 is primarily intended for or directed toward commercial
188 advantage or private monetary compensation.
189 6. *Webcasting Rights and Statutory Royalties*. For the avoidance of
